  • The websites may include hyperlinks to, or include on or in connection with, the websites (e.g., apps and plug-ins), websites, locations, platforms, applications or services operated by third parties (“Third-Party Service(s)”). GreenTek is not responsible for and makes no representations regarding the policies or business practices of any third parties, including, without limitation, analytics Service Providers and Third-Party Services associated with the Platform or Services, and encourages you to familiarize yourself with and consult their privacy notices and terms of use.
Social Features.
  • Certain functionalities on the Platform or Services permit interactions that you initiate between the Service and certain Third-Party Services, such as third-party social networks (“Social Features”). Examples of Social Features include: enabling you to send content such as contacts and photos between the Platform or Service and a Third-Party Service; “liking” or “sharing” GreenTek’s content; logging in to the Platform or Service using your Third-Party Service account (e.g., using Facebook Connect to sign-in to the Service); and to otherwise connect the Platform or Service to a Third-Party Service (e.g., to pull or push information to or from the Platform or Service). If you use Social Features, and potentially other Third-Party Services, information you post or provide access to may be publicly displayed on the Platform or Service or by the Third-Party Service that you use. Similarly, if you post information on a Third-Party Service that references the Platform or Service (e.g., by using a hashtag associated with GreenTek or other GreenTek Affiliates in a tweet or status update), your post may be used on or in connection with the Platform or Service or otherwise by GreenTek and GreenTek Affiliates. Also, both GreenTek and the third-party may have access to certain information about you and your use of the Platform or Service and any Third-Party Service.
Analytics.
  • GreenTek may use Google Analytics or other Service Providers for analytics services. These analytics services may use cookies and other Tracking Technologies to help GreenTek analyze website users and how they use the websites. Information generated by these services (e.g., your IP address and other Usage Information) may be transmitted to and stored by these Service Providers on servers in the U.S. (or elsewhere) and these Service Providers may use this information for purposes such as evaluating your use of the websites, compiling statistic reports on the websites’ activity, and providing other services relating to website activity and other Internet usage.
E. Other Purposes.

We may also use any of the Personal Information we listed above for the following purposes:

  • Operate Our Business. GreenTek uses personal information to perform core business functions, including: maintaining records for accounting or warranty purposes; debugging to identify and repair errors; collecting amounts owed to GreenTek; conducting internal audits, and; providing and maintaining the functionality of GreenTek’s website.
  • Using Data Analytics to audit, research, and conduct analysis in order to maintain and improve our services and to protect people who use our websites;
  • To protect the rights or property of GreenTek, its employees, customers, and people who use its websites.
  • Internal Purposes: Improve the Platform or Service and for any other internal business purposes reasonably related to providing the Platform or Service;
  • Tailored Content: Tailor our content, advertisements, and offers;
  • Territory Restrictions: Determine your location and manage digital content rights (e.g., territory restrictions);
  • Legal Requirements: To comply with legal process such as a search warrant, subpoena or court order, or if requested by regulatory agencies with authority over GreenTek Solutions, LLC.
  • Improve our Products or Services. We may use personal information that we collect to undertake internal research; verify or maintain the quality of our services, and; improve, upgrade or enhance our services.
  • Prevent and Detect Fraud or Other Security Incidents. GreenTek uses personal information to prevent, detect, investigate, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions, attempts to manipulate or violate our policies and terms, security incidents, and potential harm to the rights, property, or safety of GreenTek and its customers, employees, or others.
  • Other Disclosed Purposes: Fulfill other purposes disclosed at the time you provide Personal Information or otherwise where we are legally permitted or are required to do so;
F. De-Identified Data

The website may de-identify (also referred to as “anonymize”) and aggregate data for its business purposes, including but not limited to, improving the features of its services, maintaining the security and integrity of its systems, for analytics, and other legitimate business purposes. “De-identified Data” means information that cannot reasonably be used to infer information about, or otherwise be linked to a particular data subject. De-identified Data includes anonymized data and is no longer “personal data” under applicable data protection laws. Where we process De-identified Data, we commit to maintain and use the information in de-identified form and not attempt to reidentify the information, except where permitted by law. The website may disclose De-identified Data to third parties who commit themselves to maintaining the De-identified Data in anonymized form and not attempt to re-identify the data for any business purpose. To the extent any non-personal information is combined by or on behalf of GreenTek with personal information GreenTek itself collects directly from you on the websites, GreenTek will treat the combined data as described in this Notice.

2. How We Share Personal Information

We may share information about you to third parties as indicated below:

  • Within the Company Group. We share your personal data with other related entities and with our different locations, affiliates, and subsidiaries as follows:
    • Providing services;
    • Analyzing customer data and website user behavior;
    • Carrying out marketing activities;
    • Supporting shared services, such as analytics, customer relationship tools, and data management across related entities.
  • Service Providers. GreenTek utilizes other companies to perform certain services for it or on its behalf. These service providers may collect or receive your personal information so that they can provide services to GreenTek, which include:
    • Providing marketing services (such as developing campaigns, sending emails or text messages, delivering advertisements, facilitating customer product reviews);
    • Hosting or maintaining our website, servers, databases, and/or software platforms;
    • Providing fraud monitoring or detection services;
    • Conducting surveys;
    • Analyzing customer data and survey responses;
    • Content optimization service providers;
    • Invoice and billing service providers;
    • Website and application analytics providers;
    • Website testing and optimization service providers;
    • Providing or facilitating warranty or after-sales service; and
    • Providing customer service.
  • Business Partners (Third Party Businesses). GreenTek partners with other businesses to provide professional services. These third party businesses may collect or receive your personal information so that they can provide services to you and to GreenTek consistent with this Notice, which include:
    • Third Party Payment Processors – GreenTek uses PCI-DSS compliant payment processors to provide you with options to make a secure payments for the services you purchase through our website. By using one of our payment options, or otherwise processing your credit or debit card, your personal information will be collected and processed by one of our payment processors subject to their privacy policies.
    • Shipping Carriers – GreenTek uses third party shipping carriers, such as the USPS, UPS, and FedEx for shipping, handling, and fulfilling orders. Personal information collected and processed by a shipping carrier is subject to their privacy policies.
    • Professional Services – We may disclose personal information to establish, exercise, or protect the rights of GreenTek or its employees, affiliates, agents, and other customers; defend against a legal claim; protect the safety and security of our visitors; detect and protect against fraud; and take action regarding possible illegal activities or violations of our policies; legal, accounting, or consulting services.
    • Corporate Affiliates – We share personal information with our corporate affiliates.
    • Enterprise Partners – We may disclose your information to enterprise partners and third parties with your consent and at your request, if you elect to use or receive such services. Should you elect to receive such services, your information shall be governed by and subject to the privacy policy on the respective sites to which your information is sent. We are unable to effectuate any changes or deletions to your information on such sites once your information has been sent and any communications regarding your information on such sites must be made with those sites directly.
  • Data Analytics Partners. GreenTek uses or allows data analytics providers to place third party analytics cookies and pixels on its website. We may share your Usage Information personal data with these data analytics providers, and they may share your Usage Information with us as well.
  • External Auditors: For its own internal business purposes as well as its compliance obligations under the laws, GreenTek must allow external auditors to access and evaluate certain information to perform their audit function;
  • External Agencies: GreenTek is required by law to make certain reports to external agencies in order to operate within the bounds of the law and the industry regulations that apply to the GreenTek;
  • Trade Customers: If you are making a purchase from the GreenTek on behalf of your employer, we will share your information with your employer as needed to complete the transaction;
  • Legal Obligations: To comply with the law, law enforcement or other legal process, and in response to a government request, including inquiries and requests from regulatory agencies with authority over GreenTek Solutions, LLC.
  • Defending and Protecting Rights: If GreenTek believes your actions are inconsistent with GreenTek’s terms of use, user agreements, applicable terms or policies, or to protect the rights, property, life, health, security and safety of GreenTek, the Platform or Service or its users, or any third-party;
  • Corporate Transactions: In addition, GreenTek may share your Personal Information and your non-Personal Information in connection with or during negotiations of any proposed or actual merger, purchase, sale, joint venture, or any other type of acquisition or business combination of all or any portion of GreenTek assets, or transfer of all or a portion of GreenTek’s business to another company (“Corporate Transactions”);
  • Sweepstakes, Contests, and Promotions: GreenTek may offer sweepstakes, contests, and other promotions (each, a “Promotion”), including Promotions jointly sponsored or offered by third parties, which may require submitting Personal Information. If you voluntarily choose to enter a Promotion, your information, including Personal Information, may be disclosed to GreenTek, GreenTek Affiliates, co-sponsors, Service Providers, and other third parties, including for administrative purposes and as required by law (e.g., on a winners list). By entering, you are agreeing to the official rules that govern that Promotion, which may include agreeing to additional or differing data practices from those contained in this Notice. Please review those rules carefully;
  • Information You Disclose to Others; Social Networks: The Platform or Service may permit you to post or submit UGC including, without limitation, written content, user profiles, audio or visual recordings, computer graphics, pictures, data, or other content, including Personal Information. If you choose to submit UGC to any public area of the Platform or Service, your UGC will be considered “public” and will be accessible by anyone, including GreenTek. Notwithstanding anything to the contrary, unless otherwise explicitly agreed by us, Personal Information included in UGC is not subject to GreenTek’s usage or sharing limitations, or other obligations, regarding Personal Information or other Personal Information under this Notice or otherwise, and may be used and shared by GreenTek and third parties to the fullest extent not prohibited by applicable law.   • Providing Personal Data of Others: Additionally, the Platform or Service may offer you the option to send a communication to a friend. If so, GreenTek relies on you to only send to people who have given you permission to do so. The friend’s Personal Information you provide (e.g., name, e-mail address) will be used to facilitate the communication, but not used by GreenTek for any other marketing purpose unless GreenTek obtains agreement from that person. Your contact information and message may be included in the communication.

We do not sell any individual’s personal information, including information belonging to children under the age of 16, nor do we share that personal information with third parties for those parties’ commercial use.

SMS Policy. Mobile information, including phone numbers, opt-in data, and consent, will not be shared, sold, rented, or disclosed to any third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will remain strictly confidential and will not be shared with any third parties under any circumstances.

3. Choices: Selling, Tracking and Communications Options

We may use cookies and similar tracking technologies (like web beacons and pixels) to collect or store information. Specific information about how we use such technologies and how you can refuse or disable certain cookies is set out in our Cookie Policy. The use of cookies other than essential cookies, including for the purposes of targeted advertising, is performed on the basis of your consent.

A. Tracking Technologies Generally

Regular cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options so you may need to set them separately. Also, tools from commercial browsers may not be effective with regard to Flash cookies (also known as locally shared objects), HTML5 cookies, or other Tracking Technologies. B. “Do Not Track” Signals; Opt-Out Preference Signals

U.S. Residents only – Do-Not-Track Features. Many web browsers and some mobile operating systems and mobile applications include a “do-not-track” feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing do-not-track signals has been finalized and, as such, we do not currently respond to do not track browser signals or any other mechanism that automatically communicates your choice not to be tracked online. We will update this Notice if that changes in the future. These features are not an alternative to the settings you choose in our cookie banner.

C. Communications

Email Communications. You can opt out of receiving certain marketing or promotional communications from GreenTek at any time by following the instructions provided in e-mails to click on the unsubscribe link, or if available by changing your communication preferences by logging onto your account. Please note that your opt-out is limited to the e-mail address used and will not affect subsequent subscriptions. If you opt-out of only certain communications, other subscription communications may continue. Even if you opt out of receiving promotional communications, GreenTek may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or GreenTek’s ongoing business relations.

SMS / Text Messaging. You can opt-out of receiving text messages from us at any time by replying to a text with the words “STOP,” “UNSUBSCRIBE,” or “END.”

U.S. Residents only – SMS Originator Opt-in Data and Consent. GreenTek does not sell or share mobile phone information with third-parties for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. 4. Links to Social Media and Third-Party Websites

Our website may include links to blogs, social media, and third-party websites. These third-party sites have their own privacy policies and terms of use and are not controlled by this Notice or the terms of our website’s disclaimer. You should carefully review any terms, conditions and policies of such third-party sites before visiting them or supplying them with any Personal Information. If you follow a link to any third-party site, any information you provide that site will be governed by its own terms of use and privacy policy and not this Notice.

We are not responsible for the privacy or security of any information you provide to a third-party website or the information practices used by any third-party site, including links to any third-party site from the websites. We make no representations, express or implied, concerning the accuracy, privacy, safety, security or the information practices of any third-party site. The inclusion of a link to a third-party site on our website does not constitute any type of endorsement of the linked site by us. We are not responsible for any loss or damage you may sustain resulting from your use of any third-party website or any information you share with a third-party website.

5. Required Disclosures

In certain circumstances, we may choose to or may be required to provide additional or different disclosures to residents of different U.S. states or other countries. Below are the disclosures that may be applicable to you.

A. “Legal Categories” of personal information

Certain laws require us to tell you about the personal information we collect about you in a certain way – specifically, we need to tie it back to “legal categories” of personal information that are listed in the law. To do this, we bundled up the information we gave you above in this Notice and matched the different types of personal information we collect about you with the legal category. To make things easier to understand, we’ve put this information in a chart that shows you five things:

  1. the legal category of personal information and the definition for each category,
  2. the source from which your personal information is collected,
  3. The purpose for why we collect and use your personal information for each legal category, and
  4. the categories of third parties with whom we share personal information for a business purpose.

We’ve included these things in the Personal Information Privacy Chart at the end of this Notice. At the end of the Personal Information Privacy Chart, we also included a list of personal information we disclose for a business purpose.

B. European Privacy Notice

This section of our Privacy Notice applies to residents of the European Economic Area (EEA) and the United Kingdom (UK).

Processors and International Data Transfers. GreenTek primarily stores the Personal Information we collect in the United States. To facilitate GreenTek’s global operations, we and/or our service providers may transfer and access your Personal Information from locations around the world. This may involve transferring your Personal Information outside the country where you live. Your Personal Information may also be processed by employees or by other third parties who work for us, or by the representatives and employees of our parent, affiliate, or other subsidiary companies. If we transfer your Personal Information to third parties in other countries, then we will only do so if the third party offers an adequate level of protection under the law and only as necessary for the performance of our obligations. We will take steps reasonably necessary to ensure that your Personal Information is treated securely and in accordance with this Privacy Notice. We only share Personal Information with third-parties who adequately implement appropriate technical and organizational measures and who guarantee the protection of your rights as required under the laws that apply to you.

Your Privacy Rights. Under certain circumstances, individuals within the European Economic Area have rights under data protection laws in relation to your personal information as set out in the “Your Rights and Choices” section of this Notice.

Legal Bases For Processing. This section describes some of the legal bases we rely on to process your personal information. We may process your personal information for more than one legal basis depending on the specific purpose(s) for which we are using your personal information, including the following legal bases:

  • Contracts. Where we need to perform the contract we are about to enter into or have entered into with you, including to provide you services.
  • Legitimate Interests. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. The following are non-exhaustive examples of where GreenTek relies on legitimate interest to process personal information:
    • GreenTek has a legitimate interest in processing personal information relating to our existing customers in order to manage our business relationship and provide communications and information that may be of interest, including marketing communications.
    • GreenTek has a legitimate interest in using cookies as outlined in this Privacy Notice.
  • Legal Obligations. Where we need to comply with a legal or regulatory obligation.

Generally we do not rely on consent as a legal basis for processing your personal information.

6. Your Rights and ChoicesA. Privacy Rights

Some privacy laws require that we disclose to you the privacy rights that you have regarding personal information. We have defined the various privacy rights below.

  • Know: You may have the right to know what personal information is being collected, used, shared, and sold about you, including the categories, sources, and business purposes for collecting your personal information.
  • Access: You may have the right to request access to your personal information.
  • Erase, Delete: You may have the right to request that we delete or erase your personal information if we do not have a legal or business reason to keep it.
  • Correct: You may have the right to correct inaccurate personal information we have about you.
  • Data Portability: You may have the right to obtain personal information in a portable and readily usable format.
  • Object to processing of your personal information where we are relying on a legitimate interest (or that of a third party) and you feel it impacts your fundamental rights and freedoms. You also have the right to object where we are processing your personal information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your personal information if: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your personal information to you or to a third party in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided for us to use or where we used the information to perform a contract with you.
  • Complain to a government regulator if you are not satisfied with our response, depending on your location.
  • Opt Out of Sale or Sharing: You may have the right to ask us not to share or sell your personal information or use it for purposes of targeted advertising or profiling.
  • Limit Processing of Sensitive personal information: Sensitive personal information includes your Social Security number, driver’s license number, state ID card, passport number, racial or ethnic origin, union membership, and health and genetic data. You may have the right to ask us to limit our use of your Sensitive personal information to only what is required to accomplish the purposes we included in this Privacy Notice or that you reasonably expect from us. Our practice is to not process your Sensitive personal information except when it is necessary to accomplish the purposes disclosed in this Notice.
  • Non-Retaliation for Exercising Privacy Rights: You also may have the right not to receive discriminatory treatment for the exercise of any of the privacy rights conferred by applicable law.
  • Right to Appeal: If we decline to take action regarding your request to exercise any privacy right, you may have the right to appeal the decision.

These rights may be subject to certain limitations or exceptions depending on your state of residency and the purpose for which we process personal information about you.

B. Making Privacy Requests

How to Make a Request: If you would like to make a request, you may submit a request to exercise a privacy right in any of the following ways:

Once the request has been received, you may be asked to provide additional personal information for verification purposes before your request can be accommodated, including your full name, email address, telephone number, billing address, previous purchase history and order information.

Responding to Requests: Your request will be evaluated to determine whether the requested change meets legal regulatory requirements and does not risk making our other data less secure or changing our other data. If we are not able to honor any part of your request, we will tell you that in our response, as well as the reason(s) we cannot do so.

Verifying Your Identity: In order for us to look into your request, we may first need to verify your identity, meaning that we need to make sure that you are the consumer we may have collected personal information about or a person who has been duly authorized to make the request on behalf of the consumer. For example, if you make a request, we will ask you to confirm your name and email address. For certain requests, we will use a combination of your email address, name, and/or zip code to verify your identity, so that we can help protect your information.

Appealing a Denied Request: If we deny all or part of your privacy request, you may have a right to appeal that decision. If you would like to make an appeal, please contact us using the methods in the “Contact Us” section below, and include your name, email address, physical address, the type of request you made, and the reason for requesting an appeal.

Requests by Authorized Agents: You may have the right to designate someone else make privacy requests for you under the data protection laws. Authorized agents must:

  • Provide us with valid written authorization, that the third party agent has the authority to act on behalf of the individual whom they are making the request, which must include the agent’s name, email address, and phone number,
  • You must follow the instructions above to verify your own identity, and
  • The authorized agent must follow the instructions provided in this section to make a request.

As permitted by California privacy law, any request you submit to us is subject to an identification and verification process, and confirmation of the agent’s authority, which may include attestation under penalty of perjury. Absent a power of attorney, we will also require the consumer to verify their own identity. We may verify identity based on matching information you provided with data we have maintained on you in our systems. This data could include, but is not limited to, email address, mailing address, or phone number. We reserve the right to verify the validity of any third party request to exercise privacy rights on behalf of our customers to the fullest extent permitted under applicable data protection law.

C. Third Party Marketing and Your Additional California Privacy Rights

Separate from your “Do Not Sell” rights, California residents have the following additional rights regarding disclosure of your personal information to third parties for their own direct marketing purposes:

We provide California residents with the option to opt-in to sharing of “personal information” as defined by California’s “Shine the Light” law with third parties, other than with our affiliates, for such third parties’ own direct marketing purposes. We do not share personal information with non-Affiliate third parties for their direct marketing purposes absent your consent. If you are a California resident, you may request information about our compliance with the Shine the Light law and/or withdraw previously given consent to sharing with non-Affiliate third parties for their direct marketing purposes by contacting using the methods in the “Contact Us” section below. Requests must include “California Marketing Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the provided e-mail address or mailing address.

As these rights and your privacy rights are not the same and exist under different laws, you must exercise your rights under this law and the other privacy laws separately.

D. Children’s Privacy

Our website is not aimed at or intended for children. GreenTek does not knowingly collect, receive, disclose, sell or share information from children under the age of 16. If we learn that we have inadvertently collected personal information relating to a child under the age of 16, we will delete that information from our records. E. Financial Incentives, Bona Fide Loyalty Programs, and Non-Discrimination

As of the Effective Date of this Notice we did not offer any programs requiring you to limit any of your privacy rights, or otherwise require you to limit your privacy rights in connection with charging a different price or rate, or offering a different level or quality of good or service. If we do so, California law requires certain program terms and notices for California consumers and the material aspects of any such program, and the rights of California participants, will be explained and described in its program terms. Participating in any such programs will be entirely voluntary. We may add or change programs and/or their terms by posting notice on the program descriptions so check them regularly.

7. How We Protect Your Personal Information

We strive to take appropriate security measures to help safeguard your personal information from unauthorized access and disclosure. For example, only authorized employees are allowed to access personal information, and they may only access it for permitted business functions. We also use technology to protect your information, including encrypting sensitive personal information that is transferred to or from our systems. You should however access the Platform within a secure environment. Our websites may contain links to other third-party sites on the Internet. The information practices of those websites are not covered by this Privacy Notice. We are not responsible for the privacy policies of other websites.

8. How Long We Keep Your Personal Information

We will only keep your personal data for as long as it is necessary for the purposes set out in this Notice, unless a longer retention period is required or permitted by law (such as business records, tax, accounting or other legal requirements). In determining data retention periods, we take into consideration the applicable law, contractual obligations, the purposes, the necessity and your expectations.

When we have no ongoing legitimate business need to process your personal data, i.e., when we no longer have a legal basis in accordance with applicable law, we will either delete or anonymize it and we will make such determination based on applicable laws. When the processing of personal data is based on your consent, the data will be stored for as long as there is valid consent for the processing.

9. Website Terms of Use
